On the 16th of May, 2023, in the case “Báez Fernando Dario s/apelación contravención de tránsito”, (CAU 11586), the Criminal Court Judge acquitted the driver on the understanding that due legal process had not been adhered to. It was held that the minimum standards of ‘due legal process’ had not been observed, since the Infractions Court Judge failed to address the defence statements put forward by the defendant.
