On the 14th of August, 2024, in the case “Apelación de Juzgado de Faltas Municipales: Espinosa Zalazar, José María c/ Municipalidad de San Salvador de Jujuy”, File No. C-247996/24, the Seat 3 of the Second Chamber of the Administrative Litigation Court in the Jujuy Province ruled to annul the proceedings, and consequently to annul the ruling, against a driver, due to violations of both due legal process and his right to a fair trial. Specifically, the Court noted that the details pointed out in the supplementary report were far wider than those mentioned in the official report. Since this report was not handed to the driver, it undermined his ability to properly exercise his right to a fair trial. Thus, the court emphasised that the defendant must have access to the entirety of the evidence against them from the beginning. Furthermore, regarding the inclusion of photographic evidence in the case file, the Court held that the collection of evidence in legal proceedings constitutes a regulated activity, and its means of inclusion must therefore strictly comply with regulations.
