The Court Concedes An Appeal Without Advance Payment of Fine (Tucumán)
On the 26th of June, 2023, in the case, “ Palomino Luis Armando s/ Recurso de queja por apelacion denegada ", (Expte: 823/2023), the Tucumán Court, regarding the complaint filed by a private individual, granted the request for the return of their seized vehicle without advance payment of the fine. The Court understood that in this specific case the automatic application of the principle ‘solve et repete’ assumes an irrational measure that exceeded the government’s tax-collective authority. This infringed upon higher-ranking rights such as free trade and the right to a fair trial.
