The California Labour Commission Does Not Have The Jurisdiction To Hear The Claim As It Is Not Encompassed By An Employment Relationship
On the 1st of August, 2012, in the case "Rashid Alatraqchi, vs. Uber Technologies, Inc. a Delaware corporation”, (state case number: 11-42020 CT), the California Labour Commission determined that it lacked the jurisdiction around disputes that surged from independent contractors, as is in the case with Uber drivers. It concluded to dismiss the claim on the grounds that it did not concern employment relationships.
