The author notes that Uber is an intermediary platform between citizens. It is designed to make information available on-demand, such as one individual’s need to travel and another’s to provide said transport. The contract entered into to carry out the trip is governed by Article 1280 of the Civil and Commercial Code of the Nation, which regulates private passenger transportation.

He adds that if regulation, in accordance with Article 28 of the National Constitution, were established to govern this activity, said regulation could never alter, limit, restrict nor prohibit fundamental rights, such as the right to work and the right to choose consumer relationships.
