On the 8th of May, 2019, in the case “Judgment on the lack of subject-matter jurisdiction Ruling at first instance and in contested proceedings”, (File No. F 17/04674), the Court concluded that: (i) the contract that binds an Uber driver with Uber is of a commercial nature; (ii) it lacks jurisdiction over the matter, as it does not concern an employment dispute; (iii) the matter should be referred to the Paris Commercial Court, which has the exclusive jurisdiction to determine whether the parties complied with their contractual obligations.
