Uber Is A Platform That Connects Passengers With Private Drivers, Not Employees of It
On the 28th of October, 2022, in the case brought by Uber México Technology & Software, Sociedad Anónima de Capital Variable against the Government of Puebla State, the district judge declared unconstitutional the Articles 14 and 54 of the Regulations of the Transportation Law of the Puebla State. This ruling was based on the fact that drivers affiliated with Uber cannot be considered subordinates of Uber, since the company provides an intermediary service of private passenger transportation. The requirements that establish this regulation are unconstitutional since they are of an employment nature, while the relationship between Uber drivers and Uber are categorized by the so-called “collaborative economy”.
