New Decision Reaffirms That There Is No Employment Relationship Between Uber and Uber Drivers (Brazil)
On the 8th of May, 2019, in the case “Rodrido Leonardo Silva Ferreira vs. Uber do Brasil Tecnología Ltda”, (Proceso N° 0011359-34.2016.5.03.0112), the Court determined that no employment relationship existed between an Uber driver and Uber. To reach this decision, the Court held that no legal subordination existed over an Uber driver by Uber and that the company, while it could carry out recommendations, could not interfere in the execution of the contract.
