On the 31st of December, 2017,Annual Report of the Special Rapporteur for Freedom of Expression,concerning the case of Uber Colombia - where the Superintendence of Industry and Commerce ordered the blocking of the app on the grounds of unfair competition - the Commission recalled that: (i) restrictions to freedom of expression on the internet are only acceptable when they conform to international standards (tests of legality, legitimacy of purpose and proportionality of regulation); and, (ii) that the operation of the internet is governed by the principle of net neutrality and it is the duty of the States to uphold this principle through appropriate legislation.
