The author points out that the transportation service offered by taxi and remis (private taxi service) drivers is different to the service offered by Uber drivers.

With this in mind, the author underlines the mistake of attempting to apply rules to one type of service when they were designed for another. 

He quotes the High Court of Justice in CABA which explains that an activity cannot be prohibited by applying a regulatory framework that does not correspond to it. Similarly, an activity cannot be prohibited unless it has been expressly prohibited, since it would violate the legal principle set forth in Article 19 of the National Constitution.
