Infringement Report Is Rejected Due To Insurmountable Irregularity (Municipal Infractions Court)
On the 8th of May, 2019, in the case “González Ernesto Patricio Acta de Infracción N° 2709 s/ infrac. Art. N° 87 ORD. X-N° 5””, (Case No. 484/G/2023), the Municipal Infractions Court rejected the infringement report considering that it contained an irremediable irregularity. It was found that the individual who observed the alleged infringement was different to the individual who then issued the infringement report in question, and since this is a public document, it must contain all the essential requirements necessary to uphold its validity.
