Dismissal Of Claim Due To Lack Of Employment Relationship
On the 15th of January, 2021, in the case “Aziz Al Hakmaoui c/ SARL Uber B.V, SASU Uber France”, the Lyon Appeal Court was declared eligible to resolve the dispute and upheld the initial ruling that classified the relationship between Uber and the driver as a commercial, rather than an employment, one. It noted that the burden of proving an employment relationship falls on the party that claims it, and in this case it was not proved by the appellant.
