On the 20th of February, 2024, in the case"Jauregui Ricardo Alberto S/ Apelación Contravención De Tránsito”, (CAU 17548), the No. 3 Criminal Court, maintaining its legal standard, acquitted the driver involved. The Court held that the failure to record names and addresses of witnesses of the incident undermined the Court’s convictive power. As a result, the Court ruled in favour of the accused, recognising the legal status of presumption of innocence and applying the principle of “in dubio pro reo”.
