On the 7th of September, 2023, in the case “Rodriguez Diaz Javier Alexis s/ Apelación Falta Municipal”, (CAU 36283), the First Chamber of Appeals and Guarantees in the Criminal Court of Mar del Plata decided to revoke a sanction imposed on a driver. The Court based its decision on the lack of certainty regarding the events. The Court confirmed that, although the infringement report was not null, there was not sufficient evidence as it did not have the passengers’ details.
