On the 20th of August, 2024, in the case “Lamberg Walter Daniel”, the No. 1 Administrative Infractions Court acquitted the defendant, underlining that at that time Ordinance XVI N° 116 was not regulated, no Registry of Service Providers had been created nor had an Enforcement Authority been established. Additionally, the Court emphasised the prohibition of both applying ordinances by analogy and interpreting them “in malam partem” , that is to say, against the defendant.
