On the 8th of May, 2019, in the case ““Gaggia Nicolas s/ apelación contravención de tránsito”, (causa N°11065), the Court annulled the fine imposed on a driver for transporting people without municipal authority. To reach this decision, the Court examined the actions of the Infractions Court, which had failed to comply with the request to produce evidentiary measures, despite the driver denying the presence of any passenger. The Court decided that the rules of due legal process had not been adhered to. Lacking sufficient evidence, the Court declared that it was impossible to determine with sufficient certainty how the events took place to warrant a conviction.
