On the 26th of June, 2023, in the case, “ “Crocci, Albano sobre 6.1.47 – requisitos de los vehículos de transporte de pasajeros”, (CAU 26630/2022-0), all proceedings at the administrative stage were declared null because, at the moment of judicial review, the penalty of withholding the defendant’s driver’s licence had already been carried out. Furthermore, it was pointed out that such actions demonstrated a clear violation of the right to a fair trial, guarantee of due process and presumption of innocence (Article 18 of the National Constitution) of the alleged offender. Finally, it was recorded that no rule existed that allowed the UACF to seize the licence.
