On the 8th of May, 2019, in the case “Carvallo Lucas Gastón s/recurso de apelación”, (file No. 21/2.023), the Court declared null the proceedings - and, by extension, the sentence - for the defendant’s right to a fair trial having been violated. This was due to the fact that the employment status of the individual who issued the infringement report was unclear, and the evidentiary request submitted by the appellant was not granted. These were both considered essential to clarify the truth of the disputed facts.
