On the 26th of June, 2023, in the case, “ “Abraham Cristian Eduardo s/apelación contravención de tránsito”, , (causa N° 15980), the Court nullified the charge issued by the Infractions Court and acquitted the driver due to a severe violation of due legal process, which affected the defendant’s right to a fair trial. The ruling showed that during the administrative stage the driver’s offer of evidence, which contradicted the claims in the report, were denied. Additionally, it highlighted the importance of receiving witness statements and properly recording the alleged passenger’s details in the initial infringement report, especially considering the wider persecution Uber drivers receive from taxi and private taxi drivers.
