On the 12th of September, 2023, in the case “Baez Mariano s/ Apelación Falta Municipal”, (CAU 16587), Criminal Court No. 2 of Mar del Plata nullified the process which had led to a sanction on a driver. The Court based its decision on the fact that due legal process had been seriously violated. The evidence requested in the defence statement had not been produced, clearly infringing the right to a fair trial.
