New Acquittal Due To Violation Of Due Legal Process (Criminal Court Mar del Plata)
On the 26th of June, 2023, in the case, “ “Ledesma Ricardo Juan s/apelación falta municipal””, (CAU 16024), the Court acquitted the defendant considering that, contrary to what the Infractions Court Judge sustained, the defendant had ultimately offered various means of evidence and raised multiple objections in his defence against the contents of the infringement report. Furthermore, the Court underlined that it is a constitutional right, one which cannot be restricted, for the accused to present a defence. It also noted that the defendant’s arguments had not been considered in the lower court ruling, severely infringing due legal process.
