On the 26th of June, 2023, in the case, “ “Carrascosa Diego s/apelación falta municipal”, (CAU 16205), the Court acquitted the defendant, finding merit in his defence, as he offered various means of evidence and raised multiple objections against the contents of the infringement report. Furthermore, the Court underlined that it is a constitutional right, one which cannot be restricted, for the accused to present a defence. It also noted that the defendant’s arguments had not been considered in the lower court ruling, severely infringing due legal process.
