On the 16th of May, 2023, in the case “Paraschuk Julio Andres s/apelación contravención de tránsito”, (CAU 16020), the Court acquitted the defendant. The Court pointed out that defence is a constitutional right, one that cannot be restricted, and that the defendant had offered various means of evidence and raised multiple objections in his defence against the contents of the infringement report which were not provided in the lower court ruling. Furthermore, the Court highlighted the importance of receiving witness statements and properly recording the alleged passenger’s details in the initial infringement report, considering the wider persecution Uber drivers receive from taxi and private taxi drivers.
