On the 26th of June, 2023, in the case, “ “Magnano Bárbara Ailén s/apelación falta municipal”, (CAU 16579), the Court ordered the acquittal of the driver, considering that the Infractions Court Judge convicted the defendant solely based on evidence from the report, without summoning the alleged witness nor the inspectors in question. Furthermore, the Court failed to provide the defendant with access to the requested COM video recordings. Thus, it concluded that the defendant’s right to a fair trial had been clearly violated.
