Infringement Reports Should Be Clear And Legible: New Acquittal Of UberMoto Driver
On the 23rd of October, 2024, in the case “Mendieta Braian Federico”, the No. 2 Municipal Infractions Court dismissed the infringement report since the copy submitted to the defendant lacked a certain date; it did not include the month or year of issuance, and contained various illegible details. The Court added that all the requirements established by the ordinance should be stated in the reports, and “equally important, that a copy issued must be clear, identical and legible”. Finally, the Court added that motorcycles do not fall under the conventional definition of a transportation vehicle, and as such under no circumstances did an infraction occur.
