On 28th of October, 2024, in the case “Apelación de Juzgado de Faltas Municipales: Seborga, José Ángel c/Municipalidad de San Salvador de Jujuy”, File No. C-253224/24, Seat 4 of the Second Chamber of the Administrative Court of Jujuy Province once again declared null the process followed against an Uber driver. In this instance, the court noted that the subsequent inclusion of evidence, as well as the fact that the infringement report did not reflect the events as they occurred, violated due legal process, as well as the defendant’s right to a fair trial. The court particularly reasoned that it was not clear how the authorities noticed, detected or suspected that the appellant was providing an unauthorised transportation service and that the individual found in the car was a passenger.
