On the 25th of November, 2024, in the case “Torres Alejandro Fermín”, the No. 3 Municipal Infractions Court acquitted the defendant on the grounds that Ordinance XVI N° 116 does not regulate the provision of transportation services by motorcycles. The Court concluded that, since this specific activity is not regulated, the authorisation requirements of other forms of passenger transportation that are addressed in existing legislation are not applicable by analogy.
