On the 8th of October, 2024, in the case “Novoa Monica Leopoldina s/ infringir O.M. 3548/16 Mod. 4627/23", File No. 260164, the Municipal Administrative Infractions Court dismissed the defendant upon recognising that there existed common elements with the case record "Quisbert Alejandro Javier s/Recurso de apelación art. 23 inc. 5 CP”, File No. 5635/2023. In that ruling, Ordinance 2548/2016 was declared unconstitutional and the City Council was urged to regulate the activity, something that has not yet occurred. 

This ruling complies with the previous ruling “Martínez Leonardo Alberto s/ Recurso De Apelacion Art. 23 Inc. 5 C.P”, File No. 5772/2024, where the Municipal Administrative Infraction Court was ordered to adhere to the precedent set in “Quisbert” in future proceedings and decisions...
