Atypicity Of Conduct Established Due To Motorcycle Not Fitting The Definition Of A Passenger Vehicle
On the 5th of December, 2024, in the case “Mieres Walter Cristián”, the No. 2 Municipal Infractions Court acquitted an UberMoto driver. The Court held that motorcycles were not encompassed by the conventional definition of a passenger, nor cargo, transportation vehicle. Therefore, the act in question was atypical, and as such, did not count as an infringement.
