On the 3rd of August, 2023, in the case “Yema Paula s/ Apelación Falta Municipal”, (CAU 36290), the Second Chamber of Appeals and Guarantees in the Criminal Court of Mar del Plata acquitted the defendant because the presence of a passenger could not be proved. As a result, the Court held that necessary means of evidence were not produced and the mention of such presence in the report alone was not sufficient. Additionally, the Court clarified that evidence is not just necessary to commission the ruling but also to assess the regularity of the legal process.
