On the 3rd of August, 2023, in the case “Villareal Cristian Fabian s/ Apelación Falta Municipal”, (CAU 36282), the Second Chamber of Appeals and Guarantees acquitted the defendant due to the lack of evidence proving the presence of passengers. Although the presence of two passengers was mentioned in the report, this was deemed insufficient proof. As such, the Court explained that witness statements and testimony were essential to definitively determine whether two individuals had been transported in the back seat as passengers or entrapment agents.
