On the 13th of September, 2023, in the case “Sanhueza Miguel Ángel s/ Apelación Falta Municipal”, (CAU 36351), the Second Chamber of Appeals and Guarantees in the Criminal Court of Mar del Plata revoked the initial judgement and acquitted the driver due to the lack of evidence supporting the charge. The Court held that, although the infringement report was technically valid, the identification of the witness was necessary in order to prove the infraction.
