On the 15th of May, 2024, in the case “Rocha Carlos Javier”, the No. 1 Infractions Court acquitted the driver involved in the act in question. The Court held that Ordinance XVI N° 109 was not yet regulated, therefore “the principle of substantive legality requires a restrictive interpretation of the law in order to restrict the coercive power of the State. Furthermore, Ordinance X - N° 19 prohibits the application of other ordinances by analogy or their interpretation against the defendant. From all this, it follows that the prohibited conduct must be completely and clearly regulated to be able to be precisely known by any possible infractor”.
