Municipal Court of Posadas Upholds Acquittal
On the 17th of May, 2024, in the case “Diaz Ramón Eduardo”, the No. 1 Municipal Infractions Court acquitted the defendant on the grounds that Ordinance XVI N° 109 was not regulated. The Court held that the “the guidelines to infractions proceedings establish that it is impossible to take an infraction case to court without a prior accusation or omission that have been classified by an ordinance in force prior to the events in question. No other ordinance may be applied by analogy, nor may the regulation be interpreted extensively against the defendant, and if in doubt the court should err in favor of the defendant"..
