On the 17th of May, 2024, in the case “Da Silva Jorge Nestor”, the No. 1 Municipal Infractions Court declared the defendant innocent. The Court pointed out - with a clear reference to the principle established in Article 19 of the National Constitution - that “the act recorded as an infraction cannot be punished as such, according to existing regulations, given that, in principle, transporting passengers is not an activity prohibited by law”. The Court added that Ordinance XVI N° 109 had not yet been regulated, and to that end there was no procedure in place to obtain authorisation for such activity.
