Specifically, the Court noted that the details pointed out in the supplementary report were far wider than those mentioned in the official report. Since this report was not handed to the driver, it undermined his ability to properly exercise his right to a fair trial. Thus, the court emphasised that the defendant must have access to the entirety of the evidence against them from the beginning.
