The Court pointed out - with a clear reference to the principle established in Article 19 of the National Constitution - that \u201c<em>the act recorded as an infraction cannot be punished as such, according to existing regulations, given that, in principle, transporting passengers is not an activity prohibited by law<\/em>\u201d.
